PDPA: Personal Data and Privacy Policy PAP Gas One Company Limited and its affiliates (the “Company”) understand the importance of personal data protection in accordance with the Personal Data Protection Act B.E. 2562 (the “PDPA”) and intend to provide information on how the Company collects, uses, discloses, manages, handles and protect the personal data in conforming to the PDPA for the data subject as the stakeholder of the Company, nevertheless as a customer, a potential customer, or used to be our customer. The Company endeavor to protect the personal data in compliance with the PDPA and any related regulations from being reached, used, changed, or disclosed unlawfully, or without consent, or with dishonest intention that might cause any damage. This Privacy Policy is implemented by the Company for the personal data protection. Please read it carefully for your well understanding of such and acknowledgement of your legal rights. Personal Data collected, used, and disclosed by the Company “Personal Data” means any information relating to a Person, which enables the identification of such Person, whether directly or indirectly, but not including the information of the deceased Persons in particular. In case of the disclosure of Personal Data of any third party or any other person, who is the data subject, by a person to the Company due to any business transaction or any juristic act between such person and the Company, such person shall inform the data subject of the Company’s collection, use, processing and disclosure of Personal Data of the data subject and this Privacy Policy. The data subject shall include the following persons: 1. A person on completion of twenty years of age ceases to be a minor and becomes sui juris, or a minor on completion of seventeen years of age who becomes sui juris upon marriage or a minor under seventeen years of age who becomes sui juris upon marriage by the court allowance. 2. A minor under twenty years of age and does not become sui juris upon marriage as stated in Clause 1. In this case, not only the consent given by a minor is required but the consent of the holder of parental responsibility over the minor shall also be obtained. 3. A quasi-incompetent person or a person who has physical or mental infirmity, habitual prodigality or habitual intoxication or other similar causes that make him incapable of managing his own affairs, or whose management is likely to cause detriment to his own property or family, and be adjudged as quasi incompetent by the Court. In this case, the consent of the curator who has the power to act on behalf of the quasi-incompetent person shall be obtained. 4. A person of unsound mind who becomes incapacitated person and is adjudged incompetent by the Court. In this case, the consent of the custodian who has the power to act on behalf of the incompetent person shall be obtained. Personal data collected, used, and disclosed by the Company shall include the followings: 1. The information relating to a Person, which enables the identification of such Person such as name-surname, ID numbers, passport numbers, date of birth, address and contact numbers, etc. 2. The information of a Person’s asset such as title deed or vehicle plate number for instance. 3. The information relating to an authorized representative of a juristic person or an attorney , which enables identification of the authorized representative of a juristic person or the attorney such as name-surname, ID numbers, passport numbers, date of birth, address and contact numbers, etc. 4. The personal data pertaining to racial, ethnic origin, political opinions, cult, religious or philosophical beliefs, criminal records, genetic data, biometric data, health data of the data subject. 5. The information of product, services and others, for example the Company product and services, picture or motion picture. Purpose and objective of Personal Data processing of the Company 1. Contractual compliance (Tender Document/Agreement signed between the Company and a Person or a Juristic Person) 2. Legal compliance 3. Obtaining the consent in the event that the contractual provisions, legal compliance or legal practices or the use of lawful benefits of the Company is not applicable. 4. Customer/stakeholder data storage maintenance and improvement For your utmost benefit, the Company may seek for the consent and shall inform the purpose of collection, use or disclosure of the Personal Data. The Company will take necessary and appropriate measures to safely collect and manage the Personal Data in an appropriate manner. Disclosure of Personal Data The Company, by the Company’s Data Controller, may disclose the Personal Data upon the consent of data subject or as applicable by law and/or regulation. The Data Controller will collect, use or disclose the Personal Data for the purpose previously notified to the data subject. The processing of Personal Data by the Company will be done for the purpose of the supply of product and service, data analysis, statistical research, and improvement or development of product and services Data Protection Procedure The Company understands the importance of personal data protection and has put in place the Privacy Policy to protect the Personal Data from being lost, reached, destroyed, used, changed, revised or disclosed unlawfully or without the consent of data subject. The representative and employee of the Company will follow the Privacy Policy strictly and shall carefully manage the Personal Data to be safely stored, used, sent or transferred in an appropriate manner and meet with the data protection standards. Rights of the data subject The data subject is entitled to request the Company to manage with the Personal Data related to him in the formats as required by the data subject, provided that such data has been given to the Company by the data subject or the authorized representative of the data subject. Right to withdraw consent The data subject has the right to object the Company’s collection, use, or disclosure of the Personal Data concerning or related to him at any time but, however, the right shall not apply to the performance of a task carried out for the compliance with the law and regulation or the agreement between the data subject and the Company. Right to request for access, erasure or destruction In the event that the Personal Data is no longer necessary in relation to the purposes for which it was collected, used or disclosed, or the Company has no legal ground for such collection, or the Personal Data have been unlawfully collected, used, or disclosed, the data subject shall have the right to request to obtain and receive the Personal Data concerning or related to him processing by the Company, and the right to request to obtain a copy of the his consent, and the right to request the Data Controller to erase or destroy the Personal Data, or anonymize the Personal Data to become the anonymous data which cannot identify the data subject. Data Retention The collection of Personal Data by the Company shall continue at a limited time in compliance with the law and regulation whereas the data retention policy is implemented along with the security measure of data protection in outlining how to store or achieve data and when to destroy data. Changes to Privacy Policy The Company may update the Privacy Policy from time to time as appropriate to continue data security improving and take it into account of any change to Privacy Policy by posting it on the Company’s website. In the event that the consent withdrawal might cause any interruption in the Company’s services to the data subject or the Company’s liability compliance, the Company will advise the data subject of such impact upon the services quality of the Company and/or the liability compliance success of the Company. : PAP Gas One has devoted high attention to the fundamental management approach to quality organization and continuously improves its performance by using combine management techniques aiming for customer’s and stakeholder’s satisfaction as well as obtains all permits and certificates as required by law and regulation for business operation. 1.We renewed the third party liability insurance with Sompo Insurance Thailand as per the following conditions Insurance Period : From November 1,2021 to November 1,2022 Coverage : To cover all sums that PAP Gas One and/or PAP Solution shall become legally obligated to pay as damages to third party from bodily injury or property damage. This insurance cover not only cause by mis-operation of our stuff but also cause by our supply products such as LPG and/or related equipment. - Limited of Liability : Combined single limit for Third Party Property Damage & Bodily Injury at JPN100,000,000 (equivalent to 349,000,000 THB) - Deductible : PAP shall be responsible for JPY 100,000 (349,000 THB) 2.Saisan also has covering against same kind of insurance with Sompo Insurance Japan for PAP Gas One business operation. -Limited Liability : Combined singly limit for Third Party Property Damage & Bodily Injure at JPN1,000,000,000 (equivalent to 3,490,000,000 THB) -Deductible : 100,000,000 (349,000,000 THB) As combined the above 1) and 2) insurance, these insurance cover up to 1,000,000,000 JPY. I guess that PAP Gas One is the only company who cover such a big amount among the M7.
